These Terms and Conditions ("Terms") govern your use of Telos ("the Service"), operated by PRISMATIC STACK LIMITED ("we," "us," or "our"). By creating an account or using Telos, you agree to be bound by these Terms.
1. Acceptance of Terms
By signing up for Telos, you explicitly opt into and agree to these Terms. If you do not agree to these Terms, you must not use the Service.
2. Account Management
2.1 Account Creation
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Account Closure
You may close your account at any time through the Settings screen within the Telos app. Upon account closure, your access to the Service will be terminated, and we will handle your data in accordance with our Privacy Policy.
2.3 Account Deletion
PRISMATIC STACK LIMITED reserves the right to suspend, terminate, or delete accounts that violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service or other users.
3. Subscription and Payment
3.1 Payment Terms
Telos operates on a subscription basis. By subscribing, you agree to pay the fees specified at the time of purchase, which will be charged to your payment method on a recurring basis.
3.2 Changes to Payment Terms
PRISMATIC STACK LIMITED reserves the right to modify subscription fees, payment terms, or billing cycles at any time. We will provide reasonable notice of any changes, typically through email or in-app notifications. Continued use of the Service after such changes constitutes acceptance of the new terms.
3.3 Cancellation
You may cancel your subscription at any time through the app. The specific terms of cancellation, including refund policies and effective dates, will be clearly described within the app's cancellation interface.
4. Use of the Service
4.1 Training Plans and Content
Telos provides training plans, recommendations, and guidance based on your preferences, goals, and biomarker data. These plans are intended as guidance only and are not medical advice.
4.2 Your Responsibility
You are solely responsible for your health and safety when using Telos. You should:
- Consult with a healthcare professional before beginning any new exercise program
- Listen to your body and adjust or stop activities if you experience pain, discomfort, or injury
- Ensure you have appropriate equipment and a safe environment for training
- Not exceed your physical capabilities or ignore signs of overtraining
5. Limitation of Liability
5.1 No Liability for Injuries
PRISMATIC STACK LIMITED, its employees, contractors, and affiliates shall not be liable for any injuries, damages, or health issues that may arise from your use of Telos, including but not limited to:
- Physical injuries sustained during training
- Overtraining or fatigue-related issues
- Incorrect interpretation or application of training plans
- Equipment-related accidents
5.2 Service Availability
We do not guarantee that the Service will be available at all times or free from errors, interruptions, or security vulnerabilities.
6. Communications
PRISMATIC STACK LIMITED may send you transactional emails related to your account, subscription, plan updates, and important service notifications. You cannot opt out of these communications while your account is active, as they are necessary for the operation of the Service.
7. Data and Analytics
Telos uses third-party analytics tools, including Firebase, to track anonymized app events and usage patterns. This data helps us improve the Service and is handled in accordance with our Privacy Policy. Data is hashed at rest to protect your privacy.
8. Intellectual Property
All content, features, and functionality of Telos, including but not limited to text, graphics, logos, and software, are the property of PRISMATIC STACK LIMITED and are protected by copyright, trademark, and other intellectual property laws.
9. Age Restrictions
You must be at least 18 years old to use Telos, or have the consent of a parent or guardian if you are between 13 and 17 years old.
10. Modifications to Terms
PRISMATIC STACK LIMITED reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notifications. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England, without regard to its conflict of law provisions.
